Article 1 – Definitions

The following definitions apply to these General Terms and Conditions:

  • Withdrawal Period: The period during which the consumer may exercise their right to cancel the contract.

  • Continuous Contract: A distance contract for a series of products or services where obligations are carried out over time.

  • Right of Withdrawal: The option for the consumer to cancel a distance contract within the withdrawal period.

  • Business: An individual or legal entity offering products or services at a distance to consumers.

  • Distance Contract: A contract concluded between a business and a consumer via distance communication technology.

  • CESOP: Central Electronic System of Payment Information introduced by the EU to monitor payment service providers.

Article 3 – Scope of Application

These General Terms and Conditions apply to all offers made by the business and any contract entered into at a distance. Before finalizing a contract, these terms will be made available electronically or otherwise.

Article 4 – Offers

Offers are non-binding. The business reserves the right to modify offers at any time. All offers clearly state the total cost, including shipping fees, customs duties, and additional postal or courier charges.

Article 5 – Agreement

An agreement is concluded when the consumer accepts the offer and meets the specified conditions. The business will immediately confirm acceptance via email.

Article 6 – Right of Withdrawal

The consumer has the right to withdraw from the contract within 14 days from receiving the product, without providing a reason. The consumer is responsible for the return shipping costs when exercising the right of withdrawal.

Article 7 – Costs in Case of Withdrawal

The business will refund payments within 14 days of the withdrawal, provided the product is returned in its original condition.

Article 8 – Customs and VAT

The customer is solely responsible for complying with all legal obligations related to the import of goods into their destination country, including but not limited to customs fees, taxes, and clearance charges.

The business is not the official importer of products shipped to customers outside of the United States. The customer is responsible for ensuring compliance with local import regulations for purchased goods.

Any additional costs related to customs clearance, including administrative fees imposed by postal or courier services, are the sole responsibility of the customer.

The business provides necessary shipping documents but does not guarantee that goods will comply with local import regulations. Customers are advised to check the import requirements before placing an order.

Article 9 – Compliance with CESOP

As of 2024, payment service providers are required to register transaction data in the CESOP (Central Electronic System of Payment Information) in accordance with EU regulations. The business adheres to these regulations, which may affect the monitoring and reporting of payments.

Article 10 – Compliance and Warranty

The business guarantees that products are in compliance with the contract and applicable legal requirements. Complaints regarding defects must be submitted in writing within 14 days of receipt. Products must be returned in their original packaging and condition.

Article 11 – Delivery

Orders are delivered within 30 days, unless otherwise agreed. In case of delays, the business will inform the consumer within 14 days from the order date.

Orders are shipped in such a way that the customer is the recipient and legally responsible for all procedures related to importation.

The business ensures that products are shipped in compliance with international shipping regulations, but is not responsible for delays or issues during customs clearance.

Failure to comply with customs obligations does not constitute a valid reason for canceling an order or refunding the payment.

Article 12 – Complaint Resolution

Complaints must be submitted in writing within 7 days of detecting the issue. The business will respond within 14 days. If more time is needed, the business will provide an estimated resolution time.

Article 13 – Disputes

These Terms and Conditions are governed by United States law. Disputes will initially be resolved amicably. If necessary, disputes will be settled by the competent court in Boston, Massachusetts, USA.
